These Terms outline the conditions for accessing and using Cogniself, a platform operated by Cogniself LLC (“Cogniself”, “Company,” “We,” “Our”). This includes our website, mobile app, and all associated features, tools, data, software, and services provided by us (collectively referred to as the “Services”).

This document, along with our Privacy Policy and any additional terms referenced within, forms a legally binding agreement (“Agreement”) between you and the Company regarding your use of the Services. If you do not agree to these Terms, please refrain from using our platform.

No Medical Advice or Therapy Services

Cogniself does not provide therapy services or medical advice. We are not involved in diagnosing patients or practicing medicine. The Services we offer are strictly for informational and educational purposes. Please do not consider anything communicated through Cogniself as medical advice or a substitute for clinical therapy. While our website, apps, content, and communications may reference mental health topics, we make no guarantees about the accuracy, completeness, or relevance of any information provided. Even if the information is accurate, it may not be applicable to your unique situation or personality. The personality assessments and analyses provided by our platform use artificial intelligence which has inherent limitations. AI analyses are based on algorithmic patterns and statistical correlations, not clinical evaluation by qualified mental health professionals.

The personality assessments and AI analyses provided through Cogniself are not diagnostic tools and are intended for entertainment and informational purposes only. They cannot identify, confirm, rule out, or suggest the presence of any mental health condition, disorder, or illness.

We are not medical professionals, and no clinical mental health or therapeutic services are provided through our platform. Using our website and Services does not establish a doctor-patient relationship. While your interactions with Cogniself are governed by our Privacy Policy, they are not protected by laws related to physician-patient privilege or confidentiality.

If you are experiencing a mental health emergency, suicidal thoughts, or any acute psychological distress, stop using this service immediately and contact a mental health professional, call your local emergency number (such as 911), or go to your nearest emergency room. We cannot accept responsibility for any actions or outcomes resulting from the use or application of information provided through our Services. You assume full responsibility for how you use the Services and the information provided. Nothing within our platform should be interpreted as a medical opinion or an attempt to practice medicine.

Acceptance of Terms

Please review these Terms of Use and our Privacy Policy carefully. Together, these Terms of Use, the Privacy Policy, and any additional terms referenced within constitute a legally binding agreement (“Agreement”) between you—whether as an individual or representing an entity—and the Company regarding your access to and use of our Services.

By accessing, browsing, visiting, or using any part of the Services, you confirm that you have read, understood, and agreed to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you must refrain from accessing or using any portion of the Services.

Description of Services

Cogniself LLC offers personality tests, career assessments, and related services.

From time to time, we may introduce new tools, resources, features, or updates to our platform, as well as launch additional services. Any new features or services provided will be governed by these Terms of Use and any additional terms that may apply specifically to those new features or services.

Your Cogniself Account

When you create an account with Cogniself, we will request your full name, email address, and a password.

All account information is handled in accordance with our Privacy Policy. You are solely responsible for maintaining the confidentiality and security of your account credentials and are accountable for any activity associated with your account, regardless of whether you authorized it.

If your login information is lost, stolen, or you suspect unauthorized access to your account, you should promptly notify the Company in writing and update your password as soon as possible.

We reserve the right, at our sole discretion, to disallow, cancel, remove, or reassign usernames and account identifiers when deemed necessary. Additionally, we may suspend, terminate, or delete your account, with or without notice, if we determine that any activity associated with your account violates these Terms of Use, infringes the rights of others, or breaches any applicable laws or regulations.

Payment and Refund Policy

You may complete your purchase using a credit card (Visa, MasterCard, American Express, Discover) or PayPal. Accepted payment methods are subject to change at the sole discretion of Cogniself. When you place an order, your card will be authorized for the total purchase amount, which may result in an immediate hold on your funds or a temporary adjustment to your credit limit. Even if your order is subsequently canceled, the timing of authorization releases is determined by your card issuer. Your credit or debit card is typically charged when we receive your order.

Refunds are provided according to the specific terms outlined for your purchase. You may qualify for a full refund of the fees you paid for an assessment if, at the sole discretion of Cogniself, the Services did not meet your needs and there was a significant failure in delivery. For group purchases, you may be eligible for a partial refund for any unused credits associated with your account.

Changes to the Services, Accounts, and Pricing

Cogniself reserves the right, at any time and for any reason, to temporarily or permanently suspend, discontinue, terminate, or restrict access to the Services, in whole or in part, including in specific regions. In the event of such actions, we will make reasonable efforts to notify registered users in advance.

We may modify the features of any account type, withdraw existing features, introduce new ones, or create new products or account types at any time. Additionally, we reserve the right to adjust the pricing for any of our Services. If there is a price increase or a significant reduction in the features of your account, we will notify you of these changes. Notification will be sent to the email address associated with your account.

You are under no obligation to continue using the Services after receiving such a notification. However, if you do not terminate your account following the notice, your continued use of the Services will be considered acceptance of the changes

Your Use of the Services

Subject to your full compliance with these Terms of Use, the Company grants you a limited, personal, non-exclusive, revocable, non-assignable, and non-transferable license to use the Services. This license allows you to generate, view, share, and download content through the features of the Services where such functionality is provided.

This license is strictly conditional upon adherence to these Terms of Use, including but not limited to the following:

  1. Content Usage Restrictions

    • You must not copy, capture, or attempt to replicate any content from the Services except in cases where downloads or sharing have been explicitly permitted by the Company.

    • Scraping or similar methods to aggregate, repurpose, or republish content are prohibited.

    • You may not alter, remove, or tamper with any trademark, copyright, or legal notices displayed on the Services or its content (excluding content you create).

  3. Prohibited Activities

    • You must respect other users. If blocked by another user, you must not attempt to contact them through the account you were blocked from or any other account.

Failure to comply with these conditions may result in the suspension or termination of your account. Cogniself reserves the right, at its sole discretion, to take any necessary actions, including reporting violations to law enforcement or initiating legal proceedings.

By using the Services, you acknowledge and agree to these conditions. Cogniself retains the right to enforce these Terms as necessary to protect the integrity of the platform and its users.

Intellectual Property Rights

The Services, along with all content, features, and functionality (including but not limited to text, software, images, videos, audio, designs, and their selection and arrangement), are the property of Cogniself, its licensors, or other content providers. These materials are protected by United States and international laws governing copyright, trademark, patent, trade secrets, and other intellectual property rights.

All names, logos, product and service names, designs, and slogans associated with the Services are trademarks of Cogniself, its affiliates, or licensors. You are prohibited from using these trademarks without prior written consent from the Company. Other names, logos, and designs appearing on the Services are the property of their respective owners and are subject to their terms of use.

These Terms of Use allow you to access and use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Services, except as follows:

  • Temporary copies may be stored in your computer’s RAM as part of accessing and viewing the materials.

  • Your web browser may automatically cache files for display optimization.

  • You may print or download a single copy of a reasonable number of pages from the Services for personal, non-commercial use, provided you do not reproduce, publish, or distribute them further.

  • You may link to the Company’s website where permitted.

You are expressly prohibited from:

Unauthorized use of the Services or its content constitutes a violation of these Terms of Use and may infringe upon copyright, trademark, or other intellectual property laws.

Copyright Infringement and DMCA Safe Harbor

We respect the intellectual property rights of others and expect users of Cogniself LLC to do the same. To address claims of copyright infringement, we comply with the Digital Millennium Copyright Act (DMCA), which establishes a formal process for resolving such claims. If you own a copyright or are authorized to act on behalf of a copyright owner and believe that material on or through Cogniself infringes your copyright, you may submit a notice to our designated copyright agent.   2. Identification of the infringing material you want removed or access to which you want disabled, along with the URL or specific location of the material.

  3. Your contact information, including your address, phone number, and email address.

We will promptly review and take appropriate action, which may include removing or disabling access to the infringing material. In cases of repeated infringement, we reserve the right to disable or terminate user accounts as deemed necessary.

Content Disclaimer

The Services provide access to a variety of information, including articles, feedback, tips, advice, recommendations, messages, comments, posts, text, graphics, software, photographs, videos, data, and other materials (“Content”). Some Content is created by Cogniself or its partners, while other Content is contributed by users, such as in guest blog features. While Cogniself makes efforts to ensure that the Content we provide is accurate, complete, and current, we cannot guarantee its accuracy, completeness, or timeliness. We are not responsible for any inaccuracies or omissions in the Content, whether provided by us, our suppliers, or users of the Services.

Opinions, advice, statements, or other information shared by users or third parties are solely the responsibility of the individuals or entities that provided them. Cogniself does not endorse or guarantee the accuracy or reliability of any opinions, advice, or statements made available through the Services, including but not limited to those found in guest blog features.

Cogniself is not obligated to prescreen, edit, or remove Content submitted by users. However, we reserve the right, at our sole discretion and for any reason, to review, edit, refuse, remove, or relocate any user-provided Content. This right does not imply an obligation to do so.

Any claim or cause of action arising out of or related to your use of the Services must be promptly reported to the Company.

If applicable law does not allow the exclusion or limitation of liability for incidental or consequential damages, the above exclusions may not apply to you. In such cases, you acknowledge that these limitations represent a reasonable allocation of risk between you and the Company and are essential to your agreement with Cogniself. Indemnification

You agree to indemnify, defend, and hold harmless Cogniself, its successors, assigns, affiliates, agents, directors, officers, employees, and shareholders from and against any and all claims, liabilities, damages, losses, expenses, and costs, including reasonable attorneys’ fees, arising from or related to:

  1. Your Violation of These Terms: Any breach or violation of these Terms of Use by you.

  2. Account-Related Activity: Any activity conducted through your account, whether by you or by any other individual accessing your account, with or without your permission.

This indemnification obligation extends to all claims and damages, including those arising from unauthorized access or misuse of your account.

Applicable Law and Jurisdiction

If a dispute arises between you and Cogniself, we aim to provide a neutral and cost-effective way to resolve the issue promptly. These Terms of Use are governed by and will be construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

Any dispute, controversy, or claim arising from or related to this Agreement, including its breach or termination, or any services provided by you to the Company, will be resolved through binding arbitration. Arbitration will be exclusively administered by JAMS and conducted in accordance with its rules and regulations, as well as any requirements imposed by applicable state law. The decision of the arbitrator will be final and binding on all parties.

Availability of Services

Cogniself reserves the right to modify, discontinue, or change our Services at any time, with or without prior notice, and without any liability to you. We do not guarantee that the Services will always be available, uninterrupted, or free from errors.

Termination

You agree that Cogniself may terminate your account at any time if you violate any provisions of these Terms of Use.

If you are dissatisfied with Cogniself’s Services, please contact us at help@cogniself.co. If your concerns are not resolved, your sole remedy is to discontinue using the Services and terminate your account.

You may terminate your use of the Services at any time by ceasing all use of the platform and notifying Cogniself of your decision via email at help@cogniself.co

Consequences of Termination

When your account is terminated, whether by you or by Cogniself, your access to your personality assessments and any related Services will end immediately. You are solely responsible for retaining copies of any personal information or data you have uploaded to the Services prior to termination. For more details on how your user data is handled, please refer to our Privacy Policy.

Complete Agreement

These Terms constitute the entire agreement between you and Cogniself regarding your use of the Cogniself site and its content. Your use of the Cogniself site is also governed by the Cogniself Privacy Policy.

If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. No waiver of any provision of these Terms shall be considered a continuing waiver or a waiver of any other provision.
