Terms and Conditions

These Terms and Conditions ("Terms") form a legally binding agreement between you and Cogniself LLC d/b/a Cogniself ("Cogniself," "Company," "we," "our," or "us") governing your access to and use of our websites, applications, software, assessments, reports, AI tools, organization workspaces, content, communications, and related services (the "Services").
These Terms cover Cogniself's consumer, Delta, Jung, Growth Hub, shared-report, and Pro services. They are not a substitute for legal advice to you or your organization.
Acceptance of Terms
By accessing or using Cogniself, you agree to these Terms, our Privacy Policy, and any product, checkout, consent, subscription, or workspace terms shown in the Services. If you use Cogniself for a company, organization, team, or other entity, you represent that you can bind that entity.
What Cogniself Provides
Cogniself provides personality assessments, Big Five reports, additional personality reports, Cogniself Delta screening flows, Jung AI assistant features, Growth Hub tools, shared report links, and Cogniself Pro organization workspaces for recruitment, team dynamics, reporting, participant consent, billing, and related services. Features may be added, changed, limited, suspended, or discontinued.
No Medical, Mental Health, Legal, Financial, or Emergency Advice
Cogniself is not a medical provider, mental health provider, law firm, financial advisor, emergency service, or crisis support service. The Services are for informational, educational, reflective, coaching, research, and organizational support purposes only.
- Do not use Cogniself as a substitute for qualified professional advice, clinical evaluation, therapy, medical care, legal advice, financial advice, or emergency support.
- If you may harm yourself or someone else, or if you are experiencing an emergency, stop using the Services and contact emergency services or a qualified crisis resource immediately.
- Delta screening, neurodivergence content, observer input, and related reports are screening and self-understanding tools only. They are not diagnoses or clinical conclusions.
- Cogniself is not intended to create HIPAA-covered services unless a separate signed business associate agreement expressly covers that use.
- Regulated users are responsible for determining whether their use triggers healthcare, education, insurance, employment, public-sector, AI, privacy, or other sector-specific duties.
AI and Assessment Limitations
Cogniself uses software, statistical models, assessment logic, retrieval systems, and artificial intelligence to generate content. AI and assessment outputs can be incomplete, inaccurate, outdated, biased, misunderstood, or unsuitable for your circumstances.
- Scores, reports, summaries, recommendations, compatibility insights, assistant replies, citations, and action suggestions are estimates and interpretations, not objective facts about a person.
- You must not use AI outputs as the sole basis for decisions that materially affect a person, including employment, education, healthcare, housing, credit, insurance, legal, financial, safety, or disciplinary decisions.
- You must not use Cogniself for prohibited, high-risk, or regulated AI uses unless expressly permitted by law and by a separate written agreement with us.
- We do not warrant that any assessment, report, recommendation, or AI response will be accurate, complete, available, compliant with your intended use, or fit for a particular purpose.
Cogniself Pro and Employment Use
Cogniself Pro is an advisory workspace for organization-level reflection, recruitment support, team dynamics, interview preparation, onboarding, management conversations, and human review. It is not an automated employment decision system, consumer reporting agency, background check provider, employment agency, professional employer organization, or occupational health provider.
- You must not use Cogniself to make final hiring, rejection, promotion, termination, compensation, disciplinary, or other employment decisions without independent human review, job-related evidence, and legal compliance.
- You are responsible for validating whether your use of personality data, selection procedures, AI tools, reports, or recommendations is lawful, job-related, business-necessary, non-discriminatory, accessible, and appropriate.
- If your use may involve automated employment decision tools, high-risk AI, employment tests, profiling, or consequential decisions, you are responsible for audits, impact assessments, validation, notices, consent, accommodations, data rights, appeals, and human review.
- You must not ask Cogniself to infer or act on protected-class status, disability, medical conditions, mental health conditions, age, race, color, religion, sex, sexual orientation, gender identity, national origin, genetic information, union activity, pregnancy, veteran status, or other legally protected characteristics.
- Cogniself reports and scores are not background checks, credit reports, investigative consumer reports, consumer reports, legal eligibility determinations, or professional licensing determinations.
Participants, Consent, Shared Reports, and Invites
Some Services allow users, organizations, candidates, team members, observers, invitees, or report recipients to share assessment data, context, report outputs, or generated insights. You may only process another person's information when you have the legal right and any required consent.
- Participants may decline or revoke consent where available. Revocation may limit future report generation, workspace functionality, or shared outputs.
- You must give clear notices about who invited participants, what data will be shared, what reports may be generated, who may see outputs, whether the use relates to employment or team management, and how rights can be exercised.
- Shared links and invite tokens are intended only for the authorized recipient or audience. You are responsible for keeping them secure.
- Organization administrators are responsible for privacy contacts, workspace access, participant communications, and internal handling of exported or downloaded data.
Accounts, Security, and Eligibility
You must be at least eighteen (18) years old to use Cogniself unless a specific product provides a different age gate and you satisfy it. You are responsible for your account, credentials, invited users, authorized workspace members, and all activity under your account or organization.
- Provide accurate information and keep it up to date.
- Do not share credentials, bypass authentication, scrape the Services, probe systems, interfere with security controls, or use the Services in a way that could harm Cogniself or others.
- Do not upload malware, attempt model extraction, prompt-injection attacks, unauthorized vulnerability testing, rate-limit evasion, spam, credential stuffing, or automated collection of content or personal data.
- Notify us promptly at help@cogniself.co if you suspect unauthorized access or misuse.
Acceptable Use
You agree not to use the Services to violate laws or rights; generate or distribute harmful or unlawful content; submit sensitive personal information about others without authority; reverse engineer, resell, white-label, frame, benchmark, or train competing models with Cogniself content; misrepresent Cogniself outputs as diagnoses, professional advice, validated hiring decisions, legal conclusions, or official determinations; or remove or misrepresent source notices, disclaimers, attribution, consent records, or safety boundaries.
Payments, Subscriptions, Credits, and Refunds
Paid Services may include report unlocks, Delta reports, additional reports, subscriptions, organization licenses, usage allowances, credits, tokens, or other paid features. Payments may be processed by third-party providers such as Stripe.
- Prices, features, limits, taxes, billing intervals, renewal terms, and cancellation options are shown at checkout or in the relevant billing interface and may change prospectively.
- For subscriptions, automatic renewals, trials, promotional prices, and renewals, we provide required disclosures, consent flows, confirmations, reminders, fee-change notices, and cancellation methods.
- Unless required by law or expressly stated at checkout, purchases are final once a digital report, AI output, allowance, subscription period, or organization license has been delivered, generated, unlocked, consumed, or made available.
- We may issue refunds or credits in our discretion for duplicate charges, failed delivery, technical errors, or exceptional circumstances. Requests should be sent to help@cogniself.co.
- If a subscription renews automatically, you authorize recurring charges until you cancel. Cancellation stops future renewals but does not automatically refund the current period unless required by law.
- Non-waivable statutory cancellation or withdrawal rights remain available where applicable.
User Content and License to Operate the Services
You may submit assessment responses, profile information, context, chat messages, observer input, organization information, candidate or team data, report prompts, files, comments, and other content ("User Content"). You retain rights you hold in your User Content, but grant Cogniself a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, analyze, transform, and create outputs from User Content as needed to provide, secure, support, improve, and comply with obligations related to the Services.
Cogniself Intellectual Property
Cogniself and its licensors own the Services, software, product design, interfaces, templates, prompts, assessment logic, scoring logic, report structures, generated product formats, trademarks, branding, documentation, and other content we provide. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for permitted personal or internal business purposes.
Privacy, Data Protection, Export, and Deletion
Our Privacy Policy explains how we collect, use, disclose, retain, transfer, and protect personal information. Privacy controls, export, deletion, and organization-specific restrictions may vary by product, user role, jurisdiction, legal obligation, subscription, workspace ownership, participant consent, and record-retention requirements.
Non-waivable privacy, consumer-protection, data-protection, labor, employment, and AI rights continue to apply. Business and Pro customers are responsible for determining their regulated role and for obtaining any required data-processing agreement before regulated processing. Do not submit regulated data unless you have a lawful basis, notices, consents, and safeguards.
Third-Party Services
Cogniself may integrate with or rely on third-party services for authentication, hosting, storage, analytics, payments, email, voice, AI models, research retrieval, and other functions. We do not control third-party services and are not responsible for their acts, omissions, terms, policies, availability, accuracy, or security.
Beta, Preview, and Demo Features
Some features may be labeled or treated as beta, preview, demo, experimental, early access, research, or not-yet-production. These features may be changed, reset, limited, removed, or made unavailable at any time and may contain errors or incomplete data.
No Warranties
To the fullest extent permitted by law, the Services and all content, reports, outputs, recommendations, citations, integrations, and third-party services are provided "as is," "as available," and "with all faults." Cogniself disclaims all warranties, express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, uninterrupted operation, and error-free performance.
Limitation of Liability
To the fullest extent permitted by law, Cogniself and its affiliates, officers, directors, employees, contractors, licensors, suppliers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, lost profits, lost revenue, lost data, lost goodwill, business interruption, or substitute services. Cogniself's total liability for all claims relating to the Services will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid Cogniself for the specific Service during the three (3) months before the event giving rise to liability.
Indemnification
You agree to defend, indemnify, and hold harmless Cogniself and its affiliates, officers, directors, employees, contractors, licensors, suppliers, and agents from claims, damages, losses, liabilities, fines, penalties, costs, and expenses, including reasonable attorneys' fees, arising from your User Content, use or misuse of the Services, decisions based on outputs, violation of these Terms, violation of law or third-party rights, employment or participant-related use, or activity under your account or organization.
Suspension and Termination
We may suspend, restrict, or terminate access to any account, organization, workspace, feature, report, shared link, invite, or output if we believe there is a violation of these Terms, legal risk, security risk, non-payment, misuse, fraud, harm, or operational need. You may stop using the Services at any time and may request account deletion or cancellation through available settings or by contacting us.
Governing Law, Arbitration, and Class Action Waiver
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, unless applicable law gives you non-waivable rights in another jurisdiction. Before arbitration, the party raising a dispute must give written notice and allow thirty (30) days for informal resolution. Unresolved disputes will be resolved by binding arbitration administered by JAMS, except where court proceedings are allowed. Arbitration will be individual, not class, consolidated, mass, private attorney general, or representative.
Either party may bring qualifying individual claims in small claims court or seek appropriate injunctive or equitable relief. Nothing prevents you from contacting a government agency, cooperating with a regulator, seeking non-waivable public injunctive relief, or exercising non-waivable rights. You and Cogniself waive jury trial and class or representative proceedings to the fullest extent permitted by law.
Changes to These Terms
We may update these Terms from time to time. Updated Terms are effective when posted unless a later effective date is stated. Continued use of the Services after an update means you accept the updated Terms.
