Terms and Conditions

These Terms and Conditions ("Terms") form a legally binding agreement between you and Cogniself LLC d/b/a Cogniself ("Cogniself," "Company," "we," "our," or "us") governing your access to and use of our websites, applications, software, assessments, reports, AI tools, organization workspaces, content, communications, and related services (collectively, the "Services").

These Terms are designed to cover Cogniself's current consumer, Delta, Jung, Growth Hub, shared-report, and Pro services. They are not a substitute for legal advice to you or your organization.

Acceptance of Terms

By accessing or using Cogniself, you agree to these Terms, our Privacy Policy, and any product, checkout, consent, subscription, or workspace terms presented to you in the Services. If you use Cogniself on behalf of a company, organization, team, or other entity, you represent that you are authorized to bind that entity and that "you" includes both you and that entity.

What Cogniself Provides

Cogniself provides personality assessments, Big Five reports, additional personality reports, Cogniself Delta screening flows, Jung AI assistant features, Growth Hub tools, shared report links, and Cogniself Pro organization workspaces for recruitment, team dynamics, reporting, participant consent, billing, and related services. We may add, change, limit, suspend, or discontinue any feature at any time.

No Medical, Mental Health, Legal, Financial, or Emergency Advice

Cogniself is not a medical provider, mental health provider, law firm, financial advisor, emergency service, or crisis support service. The Services are for informational, educational, reflective, coaching, research, and organizational support purposes only. They do not diagnose, treat, prevent, cure, or monitor any disease, disorder, disability, mental health condition, neurodevelopmental condition, or legal or financial issue. Cogniself is not FDA-cleared, FDA-approved, CE-marked, or otherwise authorized as a medical device, clinical decision support system, diagnostic tool, or treatment tool.

AI and Assessment Limitations

Cogniself uses software, statistical models, assessment logic, retrieval systems, and artificial intelligence to generate content. AI and assessment outputs can be incomplete, inaccurate, outdated, biased, misunderstood, or unsuitable for your circumstances. You are responsible for reviewing outputs before relying on them.

Cogniself Pro and Employment Use

Cogniself Pro is an advisory workspace for organization-level reflection, recruitment support, team dynamics, interview preparation, onboarding, management conversations, and human review. It is not an automated employment decision system, consumer reporting agency, background check provider, employment agency, professional employer organization, or occupational health provider, and must not be used as one.

Participants, Consent, Shared Reports, and Invites

Some Services allow users, organizations, candidates, team members, observers, invitees, or report recipients to share assessment data, context, report outputs, or generated insights. You may only invite, upload, link, share, or process another person's information when you have the legal right and any required consent to do so.

Accounts, Security, and Eligibility

You must be at least eighteen (18) years old to use Cogniself unless we expressly provide a different age gate for a specific product and you satisfy it. You are responsible for your account, credentials, users you invite, workspace members you authorize, and all activity under your account or organization.

Acceptable Use

You agree not to use the Services to:

Payments, Subscriptions, Credits, and Refunds

Paid Services may include report unlocks, Delta reports, additional reports, subscriptions, organization licenses, usage allowances, credits, tokens, or other paid features. Payments may be processed by third-party providers such as Stripe.

User Content and License to Operate the Services

You may submit assessment responses, profile information, context, chat messages, observer input, organization information, candidate or team data, report prompts, files, comments, and other content ("User Content"). You retain rights you hold in your User Content, but grant Cogniself a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, analyze, transform, and create outputs from User Content as needed to provide, secure, support, improve, and comply with obligations related to the Services.

Cogniself Intellectual Property

Cogniself and its licensors own the Services, software, product design, interfaces, templates, prompts, assessment logic, scoring logic, report structures, generated product formats, trademarks, branding, documentation, and other content we provide. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your permitted personal or internal business purposes.

Privacy, Data Protection, Export, and Deletion

Our Privacy Policy explains how we collect, use, disclose, retain, transfer, and protect personal information. Privacy controls, export, deletion, and organization-specific restrictions may vary by product, user role, jurisdiction, legal obligation, active subscription, workspace ownership, participant consent, and record-retention requirements.

Third-Party Services

Cogniself may integrate with or rely on third-party services for authentication, hosting, storage, analytics, payments, email, voice, AI models, research retrieval, and other functions. We do not control third-party services and are not responsible for their acts, omissions, terms, policies, availability, accuracy, or security.

Beta, Preview, and Demo Features

Some features may be labeled or treated as beta, preview, demo, experimental, early access, research, or not-yet-production. These features may be changed, reset, limited, removed, or made unavailable at any time and may contain errors or incomplete data.

No Warranties

To the fullest extent permitted by law, the Services and all content, reports, outputs, recommendations, citations, integrations, and third-party services are provided "as is," "as available," and "with all faults." Cogniself disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, uninterrupted operation, and error-free performance.

Limitation of Liability

To the fullest extent permitted by law, Cogniself and its affiliates, officers, directors, employees, contractors, licensors, suppliers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, lost profits, lost revenue, lost data, lost goodwill, business interruption, or substitute services, even if advised of the possibility of such damages. To the fullest extent permitted by law, Cogniself's total liability for all claims relating to the Services will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid Cogniself for the specific Service giving rise to the claim during the three (3) months before the event giving rise to liability.

Indemnification

You agree to defend, indemnify, and hold harmless Cogniself and its affiliates, officers, directors, employees, contractors, licensors, suppliers, and agents from and against all claims, damages, losses, liabilities, fines, penalties, costs, and expenses, including reasonable attorneys' fees, arising from or related to your User Content, your use or misuse of the Services, your decisions or actions based on outputs, your violation of these Terms, your violation of law or third-party rights, your employment or participant-related use, or activity under your account or organization.

Suspension and Termination

We may suspend, restrict, or terminate access to any account, organization, workspace, feature, report, shared link, invite, or output at any time if we believe there is a violation of these Terms, legal risk, security risk, non-payment, misuse, fraud, harm to others, or operational need. You may stop using the Services at any time, and you may request account deletion or cancellation through available settings or by contacting us.

Governing Law, Arbitration, and Class Action Waiver

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, unless applicable law gives you non-waivable rights in another jurisdiction. Before either party starts arbitration, the party must give the other written notice of the dispute and allow thirty (30) days for informal resolution. Any unresolved dispute arising from or relating to these Terms or the Services will be resolved by binding arbitration administered by JAMS, except where these Terms or applicable law allow court proceedings. Arbitration will be conducted on an individual basis and not as a class, consolidated, mass, private attorney general, or representative action, to the fullest extent permitted by law.

Changes to These Terms

We may update these Terms from time to time. Updated Terms are effective when posted unless a later effective date is stated. Your continued use of the Services after an update means you accept the updated Terms.
