Terms and Conditions

These Terms and Conditions ("Terms") form a legally binding agreement between you and Cogniself LLC d/b/a Cogniself ("Cogniself," "Company," "we," "our," or "us") governing your access to and use of our websites, applications, software, assessments, reports, AI tools, organization workspaces, content, communications, and related services (collectively, the "Services").
These Terms are designed to cover Cogniself's current consumer, Delta, Jung, Growth Hub, shared-report, and Pro services. They are not a substitute for legal advice to you or your organization.
Acceptance of Terms
By accessing or using Cogniself, you agree to these Terms, our Privacy Policy, and any product, checkout, consent, subscription, or workspace terms presented to you in the Services. If you use Cogniself on behalf of a company, organization, team, or other entity, you represent that you are authorized to bind that entity and that "you" includes both you and that entity.
What Cogniself Provides
Cogniself provides personality assessments, Big Five reports, additional personality reports, Cogniself Delta screening flows, Jung AI assistant features, Growth Hub tools, shared report links, and Cogniself Pro organization workspaces for recruitment, team dynamics, reporting, participant consent, billing, and related services. We may add, change, limit, suspend, or discontinue any feature at any time.
No Medical, Mental Health, Legal, Financial, or Emergency Advice
Cogniself is not a medical provider, mental health provider, law firm, financial advisor, emergency service, or crisis support service. The Services are for informational, educational, reflective, coaching, research, and organizational support purposes only. They do not diagnose, treat, prevent, cure, or monitor any disease, disorder, disability, mental health condition, neurodevelopmental condition, or legal or financial issue. Cogniself is not FDA-cleared, FDA-approved, CE-marked, or otherwise authorized as a medical device, clinical decision support system, diagnostic tool, or treatment tool.
- Do not use Cogniself as a substitute for qualified professional advice, clinical evaluation, therapy, medical care, legal advice, financial advice, or emergency support.
- If you may harm yourself or someone else, or if you are experiencing an emergency, stop using the Services and contact emergency services or a qualified crisis resource immediately.
- Delta screening, neurodivergence-related content, observer input, and related reports are screening and self-understanding tools only. They are not diagnoses and must not be treated as clinical conclusions.
- The Services are not intended to create HIPAA-covered services. If you are a HIPAA covered entity or business associate, do not submit protected health information to Cogniself unless we have signed a separate business associate agreement that expressly covers that use.
- Healthcare, education, insurance, benefits, public-sector, and other regulated users are responsible for determining whether their use of Cogniself triggers sector-specific duties before submitting regulated data or relying on any output.
AI and Assessment Limitations
Cogniself uses software, statistical models, assessment logic, retrieval systems, and artificial intelligence to generate content. AI and assessment outputs can be incomplete, inaccurate, outdated, biased, misunderstood, or unsuitable for your circumstances. You are responsible for reviewing outputs before relying on them.
- Scores, reports, summaries, recommendations, compatibility insights, assistant replies, citations, and action suggestions are estimates and interpretations, not objective facts about a person.
- You must not use AI outputs as the sole basis for decisions that may materially affect a person, including employment, education, healthcare, housing, credit, insurance, legal, financial, safety, or disciplinary decisions.
- You must not use Cogniself for social scoring, workplace or education emotion recognition, biometric identification or categorization, predictive policing, eligibility for essential services, or other prohibited, high-risk, or regulated AI uses unless that use is expressly permitted by law and by a separate written agreement with us.
- We do not warrant that any assessment, report, recommendation, or AI response will be accurate, complete, available, compliant with your intended use, or fit for a particular purpose.
Cogniself Pro and Employment Use
Cogniself Pro is an advisory workspace for organization-level reflection, recruitment support, team dynamics, interview preparation, onboarding, management conversations, and human review. It is not an automated employment decision system, consumer reporting agency, background check provider, employment agency, professional employer organization, or occupational health provider, and must not be used as one.
- You must not use Cogniself to make final hiring, rejection, promotion, termination, compensation, disciplinary, or other employment decisions without independent human review, job-related evidence, and compliance with applicable laws.
- You are responsible for validating whether your use of personality data, selection procedures, AI tools, reports, or recommendations is lawful, job-related, business-necessary, non-discriminatory, accessible, and appropriate for each role and jurisdiction.
- If your use may involve an automated employment decision tool, automated decision-making technology, high-risk AI system, employment test, selection procedure, profiling, or consequential decision, you are responsible for all required audits, impact assessments, validation, notices, consent, worker or candidate disclosures, accommodations, data rights, appeal rights, and human review.
- You must not ask Cogniself to infer or act on protected-class status, disability, medical conditions, mental health conditions, age, race, color, religion, sex, sexual orientation, gender identity, national origin, genetic information, union activity, pregnancy, veteran status, or any other legally protected characteristic.
- You are responsible for notices, consent, accommodations, record keeping, audits, adverse-impact analysis, and any legally required explanations, appeals, or human review.
- Cogniself reports and scores are not background checks, credit reports, investigative consumer reports, consumer reports, legal eligibility determinations, or professional licensing determinations. You must not use them in a way that would require Cogniself to act as a consumer reporting agency or similar regulated provider unless we sign a separate written agreement that says otherwise.
Participants, Consent, Shared Reports, and Invites
Some Services allow users, organizations, candidates, team members, observers, invitees, or report recipients to share assessment data, context, report outputs, or generated insights. You may only invite, upload, link, share, or process another person's information when you have the legal right and any required consent to do so.
- Participants may decline or revoke consent where the Services provide that option. Revocation may limit or disable future report generation, workspace functionality, or shared outputs.
- You must give participants clear notices about who invited them, what data will be shared, what reports may be generated, who may see those outputs, whether the use relates to employment or team management, and how they can exercise any available consent, access, correction, deletion, objection, opt-out, or appeal rights.
- Shared links and invite tokens are intended only for the recipient or authorized audience. You are responsible for keeping links and tokens secure and for not forwarding private reports without permission.
- Organization administrators are responsible for configuring privacy contacts, workspace access, participant communications, and internal handling of exported or downloaded data.
Accounts, Security, and Eligibility
You must be at least eighteen (18) years old to use Cogniself unless we expressly provide a different age gate for a specific product and you satisfy it. You are responsible for your account, credentials, users you invite, workspace members you authorize, and all activity under your account or organization.
- Provide accurate information and keep it up to date.
- Do not share credentials, bypass authentication, scrape the Services, probe our systems, interfere with security controls, or use the Services in a way that could harm Cogniself or others.
- Do not upload malware, attempt model extraction, prompt-injection attacks, unauthorized vulnerability testing, rate-limit evasion, spam, credential stuffing, or automated collection of content or personal data.
- Notify us promptly at help@cogniself.co if you suspect unauthorized access or misuse.
Acceptable Use
You agree not to use the Services to:
- violate laws, regulations, third-party rights, contractual duties, platform rules, employment laws, privacy laws, or anti-discrimination laws;
- generate, upload, request, or distribute unlawful, abusive, defamatory, deceptive, harassing, exploitative, discriminatory, infringing, invasive, or harmful content;
- submit sensitive personal information about another person without authority, including health, employment, assessment, biometric, financial, government identifier, or protected-class information;
- reverse engineer, copy, resell, white-label, sublicense, frame, mirror, benchmark for competitive purposes, or train competing models or services using Cogniself content, outputs, prompts, interfaces, or systems;
- misrepresent Cogniself outputs as clinical diagnoses, professional advice, validated hiring decisions, legal conclusions, or official determinations about a person.
- use the Services to develop, train, evaluate, benchmark, or improve a competing product or model, or to remove, obscure, or misrepresent source notices, disclaimers, attribution, consent records, or safety boundaries.
Payments, Subscriptions, Credits, and Refunds
Paid Services may include report unlocks, Delta reports, additional reports, subscriptions, organization licenses, usage allowances, credits, tokens, or other paid features. Payments may be processed by third-party providers such as Stripe.
- Prices, features, limits, taxes, billing intervals, renewal terms, and cancellation options are shown at checkout or in the relevant billing interface and may change prospectively.
- For subscriptions, automatic renewals, continuous services, trials, promotional prices, and renewals, we will provide the disclosures, affirmative consent flow, retainable confirmation, renewal reminders, fee-change notices, and cancellation methods required by applicable law. Where online cancellation is required, cancellation will be available online without unreasonable obstruction or delay.
- Unless required by law or expressly stated at checkout, purchases are final once a digital report, AI output, usage allowance, subscription period, or organization license has been delivered, generated, unlocked, consumed, or made available.
- We may issue refunds or credits in our discretion for duplicate charges, failed delivery, technical errors, or other exceptional circumstances. Refund requests should be sent to help@cogniself.co.
- If a subscription renews automatically, you authorize recurring charges until you cancel. Cancellation stops future renewals but does not automatically refund the current period unless required by law.
- If you are in a jurisdiction that gives you a statutory cancellation or withdrawal right for digital content or digital services, those rights remain available to the extent they cannot be waived. Where legally permitted, by requesting immediate access, generation, or delivery of digital content, you consent to immediate performance and acknowledge that you may lose cancellation or withdrawal rights once performance begins.
User Content and License to Operate the Services
You may submit assessment responses, profile information, context, chat messages, observer input, organization information, candidate or team data, report prompts, files, comments, and other content ("User Content"). You retain rights you hold in your User Content, but grant Cogniself a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, analyze, transform, and create outputs from User Content as needed to provide, secure, support, improve, and comply with obligations related to the Services.
- You represent that you have all rights, permissions, notices, and consents required to submit User Content and allow Cogniself to process it, including any rights required for sensitive, employment, health-related, participant, candidate, observer, organization, or third-party data.
- You are responsible for the accuracy, legality, quality, and suitability of User Content and for decisions made using outputs derived from it.
- We may remove or restrict User Content or outputs when we believe they violate these Terms, create risk, or are required to be restricted by law.
Cogniself Intellectual Property
Cogniself and its licensors own the Services, software, product design, interfaces, templates, prompts, assessment logic, scoring logic, report structures, generated product formats, trademarks, branding, documentation, and other content we provide. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your permitted personal or internal business purposes.
Privacy, Data Protection, Export, and Deletion
Our Privacy Policy explains how we collect, use, disclose, retain, transfer, and protect personal information. Privacy controls, export, deletion, and organization-specific restrictions may vary by product, user role, jurisdiction, legal obligation, active subscription, workspace ownership, participant consent, and record-retention requirements.
- These Terms do not require anyone to waive non-waivable privacy, consumer-protection, data-protection, labor, employment, or AI rights. If a term conflicts with a non-waivable right, that right controls and the rest of these Terms remains in effect.
- Business and Pro customers are responsible for determining whether they act as a controller, processor, business, service provider, employer, deployer, provider, developer, or similar regulated role under applicable privacy or AI laws, and for obtaining any required data-processing agreement before using Cogniself for regulated processing.
- You must not submit special-category, sensitive, protected-class, health, biometric, child, employment, or other regulated data unless you have a lawful basis, all required notices and consents, and any required safeguards for that processing.
- Account deletion may be delayed, restricted, or denied where needed to preserve legal records, prevent fraud, maintain security, complete transactions, protect other users, or prevent an organization from losing its only active owner.
- Deleting or unlinking personal data may make reports, shared links, Pro projects, Jung context, Growth Hub items, or historical outputs unavailable or incomplete.
- If your use of Cogniself involves automated decision-making, profiling, high-risk AI, or decisions with legal or similarly significant effects, you are responsible for any required transparency, assessment, logging, data-subject rights, human oversight, appeal, and regulator-facing documentation.
Third-Party Services
Cogniself may integrate with or rely on third-party services for authentication, hosting, storage, analytics, payments, email, voice, AI models, research retrieval, and other functions. We do not control third-party services and are not responsible for their acts, omissions, terms, policies, availability, accuracy, or security.
Beta, Preview, and Demo Features
Some features may be labeled or treated as beta, preview, demo, experimental, early access, research, or not-yet-production. These features may be changed, reset, limited, removed, or made unavailable at any time and may contain errors or incomplete data.
No Warranties
To the fullest extent permitted by law, the Services and all content, reports, outputs, recommendations, citations, integrations, and third-party services are provided "as is," "as available," and "with all faults." Cogniself disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, uninterrupted operation, and error-free performance.
Limitation of Liability
To the fullest extent permitted by law, Cogniself and its affiliates, officers, directors, employees, contractors, licensors, suppliers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, lost profits, lost revenue, lost data, lost goodwill, business interruption, or substitute services, even if advised of the possibility of such damages. To the fullest extent permitted by law, Cogniself's total liability for all claims relating to the Services will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid Cogniself for the specific Service giving rise to the claim during the three (3) months before the event giving rise to liability.
Indemnification
You agree to defend, indemnify, and hold harmless Cogniself and its affiliates, officers, directors, employees, contractors, licensors, suppliers, and agents from and against all claims, damages, losses, liabilities, fines, penalties, costs, and expenses, including reasonable attorneys' fees, arising from or related to your User Content, your use or misuse of the Services, your decisions or actions based on outputs, your violation of these Terms, your violation of law or third-party rights, your employment or participant-related use, or activity under your account or organization.
Suspension and Termination
We may suspend, restrict, or terminate access to any account, organization, workspace, feature, report, shared link, invite, or output at any time if we believe there is a violation of these Terms, legal risk, security risk, non-payment, misuse, fraud, harm to others, or operational need. You may stop using the Services at any time, and you may request account deletion or cancellation through available settings or by contacting us.
Governing Law, Arbitration, and Class Action Waiver
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, unless applicable law gives you non-waivable rights in another jurisdiction. Before either party starts arbitration, the party must give the other written notice of the dispute and allow thirty (30) days for informal resolution. Any unresolved dispute arising from or relating to these Terms or the Services will be resolved by binding arbitration administered by JAMS, except where these Terms or applicable law allow court proceedings. Arbitration will be conducted on an individual basis and not as a class, consolidated, mass, private attorney general, or representative action, to the fullest extent permitted by law.
- Either party may bring an individual claim in small claims court if the claim qualifies. Either party may also seek injunctive or equitable relief in court for intellectual property misuse, unauthorized access, security incidents, or misuse of confidential information.
- For consumer arbitrations, the arbitration clause is intended to be reciprocally binding, preserve remedies that cannot be waived, permit reasonable participation in arbitrator selection, allow relevant non-privileged discovery, provide a written award, and follow the JAMS Consumer Minimum Standards where they apply.
- Nothing in this section prevents you from bringing a claim to a government agency, cooperating with a regulator, seeking public injunctive relief where that right cannot be waived, or exercising non-waivable rights under consumer, privacy, labor, employment, or data-protection law.
- You and Cogniself waive any right to a jury trial and any right to bring or participate in a class action, class arbitration, consolidated action, mass arbitration, private attorney general action, or other representative proceeding, to the fullest extent permitted by law.
Changes to These Terms
We may update these Terms from time to time. Updated Terms are effective when posted unless a later effective date is stated. Your continued use of the Services after an update means you accept the updated Terms.
